At our next lunch seminar, on September 14, 2010, we anticipate having a speaker discuss the implications of the Minnesota Supreme Court’s Decision in Swanson v. Brewster. That case will change the way collateral-source (under Minn. Stat. Sec. 548.251) offsets are viewed and applied in future litigation.”

TOPIC: Explaining the Minnesota Supreme Court’s Recent Collateral – Source Offset Decision: Swanson v. Brewster.
In that decision, the Court interpreted a new question under Minnesota’s collateral-source statute, Minn. Stat. §548.251. The Court held that a defendant can offset the amounts that a plaintiff receives via his health insurer’s negotiated discounts with medical providers. The presentation will discuss the decision itself and how it will affect claims handling and defending your insureds.
