They will present evidence, take a direct and cross-examination of the claimant, and make closing arguments to the arbitrator.  You will learn about various legal and factual arguments made by both claimant’s attorneys and defense attorneys at arbitration and how best to prepare your file for that eventual arbitration.  The participants will engage in a discussion of the arbitration after presented for full involvement of the audience on this important topic.

Mediation and Settlement Trends in Minnesota.  As an experienced and successful mediator, Ms. Preddy will discuss the trends in settlement and mediation she has observed in recent years.  The speech will discuss how a claims adjuster can prepare for successful mediation and what an adjuster should demand from plaintiff and defense attorneys to best prepare for mediation.

It has long been the law in Minnesota that insurers cannot seek contribution from other insurers for the same insured unless there is a loan receipt agreement.  This is often called the Iowa National Rule.  But, a recent Minnesota Court of Appeals decision appears to disturb that rule and create a new method for insurers to seek contribution from each other.  Come and hear Mr. Veith’s discussion of this important topic as well as the use of contractual indemnity provisions in subcontracts to shift defenses costs from contractors to subcontractors.

Mr. Smetak will discuss the landscape in this area, as well as a recent case he argued before the Minnesota Court of Appeals. Meyer v. Nwokedi, Enterprise Rent-A-Car Co., File No. A08-0250 (Minn. App. Jan 20, 2009). This is the first and only appellate decision on the effects of the Grave Amendment upon Minnesota’s vicarious liability. UIM insurers will need to consider it.
